These Terms and Conditions ("Terms") govern your use of the Creator Factory website and services. By accessing our site or submitting an application, you agree to be bound by these Terms. If you do not agree, please do not use our services.

Acceptance of Terms

By using our website or submitting an application, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

Eligibility

You must be at least 18 years old to apply. You are responsible for ensuring that your use of our services complies with the laws of your jurisdiction and with the terms of the platforms you use.

Applications and Selection

Submitting an application does not guarantee acceptance. We review each application based on engagement quality, audience authenticity, content consistency, and commercial fit. We may accept or decline applications at our discretion.

Brand Partnerships and Deals

We may introduce you to brand partners and negotiate partnerships on your behalf. The final decision to enter any agreement remains yours. We are not a party to the agreement between you and a brand unless stated otherwise in writing.

Fees and Commission

We operate on a commission model. We earn a percentage of the brand deals we secure for you. There are no upfront fees. Specific commission rates are agreed in writing before any partnership is finalized.

Creator Obligations

You agree to provide accurate information, to deliver agreed content on time, to disclose any conflicts of interest, and to comply with applicable advertising and disclosure regulations, including clearly labeling sponsored content.

90-Day Guarantee

If we do not present you with a qualifying brand deal within your guarantee period, we will pay you USD 500, provided you meet every condition set out below and submit a valid claim.

Your guarantee period is the 90 days starting on the date you complete all onboarding and verification steps. It does not run from the date you sign up.

A qualifying brand deal means we present or offer you an opportunity to promote a partner — on a flat fee, CPA, revenue share, hybrid, or any other basis, and at any value. Presenting the opportunity is what counts. You do not need to accept it, earn a particular amount from it, or be happy with its terms. An opportunity you decline, ignore, or do not act on still counts.

Conditions. The guarantee applies only if you meet and keep meeting all of the following throughout your guarantee period:

• You complete all onboarding and verification we ask for — including identity, proof of age, tax information, and payment details — within 7 days of signing up.
• You connect your social media account(s) and maintain the minimum follower and engagement levels we notify to you.
• You produce and post all content we assign, on the schedule and at the frequency we notify, without missing any required post.
• You correctly use all tracking links, promo codes, and attribution methods on every post.
• You respond to our matching requests, instructions, and communications within 48 hours.
• You do not decline, ignore, or fail to act on any brand match or opportunity we offer.
• You comply fully with these Terms and are not in breach, or under investigation for breach.
• You do not engage in fraudulent, incentivised, artificial, or bad-faith activity, and do not attempt to manufacture eligibility for the payment.

Missing any condition at any point during the guarantee period voids the guarantee in full, even if you later put it right. The guarantee is offered at our discretion, and we may — acting reasonably — decline, reduce, or withhold the payment where we consider that you have not genuinely met the conditions, have tried to game or manufacture eligibility, or have otherwise acted in bad faith. Our decision on eligibility and entitlement is final.

Making a claim. Send us a written claim within 14 days after your guarantee period ends, stating that you received no qualifying brand deal and confirming that you met all of the conditions. A claim that is late or missing those confirmations is invalid and the guarantee is void. We may ask for evidence to verify a claim and may hold payment until we have verified it.

Payment. If we accept a valid claim, we will pay within 30 days of accepting it, either as credit against your future earnings or by a payment method we choose. The USD 500 payment is your sole and exclusive remedy in connection with the guarantee, is capped at USD 500, and is payable once per creator. We may change, suspend, or withdraw the guarantee for creators who have not yet started a guarantee period; this will not affect anyone already inside one.

Intellectual Property

You retain ownership of the content you create. By submitting an application, you grant us a limited license to use your name, handle, and profile information for the purpose of presenting you to brand partners and promoting our services.

Disclaimers

Our services are provided on an "as is" basis. We do not guarantee specific results, revenue levels, or brand partnerships. Earnings depend on many factors outside our control. Nothing in this section limits the 90-Day Guarantee, which applies only on the terms set out in that section.

Limitation of Liability

To the fullest extent permitted by law, Creator Factory shall not be liable for any indirect, incidental, or consequential damages arising from your use of our services.

Termination

Either party may end the working relationship at any time by providing written notice. Obligations that by their nature should survive termination will continue to apply.

Changes to These Terms

We may update these Terms from time to time. The latest version will always be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the revised Terms.
